These Terms of Service govern your use of the Shadow Tier Figures website and your purchase of products from our online store.
By placing an order with us, you confirm that you have read, understood and agreed to these Terms of Service.
1. ABOUT US
Shadow Tier Figures is a small independent business specialising in 1/6 scale 3D-printed resin model kits and figures.
Our products are intended for experienced or proficient adult modellers and hobbyists. They are supplied as unfinished kits and require assembly, preparation, filling, sanding, bonding and painting by the customer.
2. OUR PRODUCTS
Unless specifically stated otherwise, our products are supplied as unfinished 3D-printed resin model kits.
Products may include:
- Multiple resin-printed parts requiring assembly.
- A display base where specified in the product description.
- Parts requiring sanding, filling and joining.
- Visible or minor print/support marks that require preparation.
- Parts that may require additional preparation before painting.
- A fixed-pose figure rather than an articulated or functional action figure.
The photographs shown on our website and social media are examples of completed models. They are intended to demonstrate possible finishing and painting results and do not necessarily represent the exact appearance of the unassembled kit supplied.
Unless specifically stated in the product description, paint, glue, filler, tools and other modelling materials are not included.
3. INTENDED USE
Our products are intended as scale-model kits and hobby/display items for adult modellers.
They are not toys and are not intended for children.
Our products may contain:
- Small parts.
- Sharp or pointed components.
- Brittle or delicate resin parts.
- Parts with fine details that can be damaged if handled incorrectly.
Keep unfinished kits and small components away from young children and pets.
4. MODELLING SKILL REQUIRED
Our kits are intended for customers who have suitable modelling experience or are confident undertaking model-making processes.
You may need to undertake some or all of the following:
- Removing support material.
- Washing and cleaning parts where required.
- Sanding.
- Filing.
- Filling imperfections or seams.
- Drilling.
- Pinning or reinforcing joints where appropriate.
- Cutting or modifying parts where necessary.
- Bonding parts using a suitable adhesive.
- Priming.
- Painting.
- Applying finishing products.
We cannot guarantee that every customer will be able to successfully assemble or finish a kit.
Please ensure that you are comfortable undertaking these processes before purchasing.
If you are unsure whether a particular kit is suitable for your skill level, please contact us before placing your order.
5. RESIN AND FRAGILE PARTS
3D-printed resin is considerably more brittle than many injection-moulded plastics.
Fine or thin components can break if excessive force is applied.
Minor breakage during assembly does not necessarily indicate that a product is defective.
Customers should handle all parts carefully and use appropriate modelling techniques and tools.
Where appropriate, delicate components may need to be reinforced or repaired by the modeller.
We recommend reading our preparation and safety guidance before beginning work on a kit.
6. PRINT AND SURFACE FINISH
3D printing is an additive manufacturing process and some characteristics are inherent to the process.
Depending on the product, minor characteristics may include:
- Layer lines.
- Support marks.
- Small surface imperfections.
- Minor print artefacts.
- Slight variations in surface finish.
- Minor imperfections requiring filling or sanding.
These are considered part of the normal preparation process for a 3D-printed model kit.
Our products are not intended to be supplied with the same surface finish as a factory-produced, injection-moulded or professionally finished model.
However, we will make reasonable efforts to ensure that the parts supplied are suitable for preparation and completion by a competent modeller.
7. PRODUCT IMAGES AND COLOUR
Product photographs may show completed and painted examples.
The colours, weathering, finish and appearance shown in photographs are examples only.
The customer is free to finish and paint the model according to their own preferences.
The actual colour and appearance of an unpainted resin kit may vary from photographs due to photography, lighting, screen settings and the resin used.
8. ORDERS
When you place an order through our Shopify store, you are making an offer to purchase the products in your basket.
After placing an order, you will receive an order confirmation acknowledging receipt of your order.
The order confirmation does not necessarily constitute acceptance of the order.
We reserve the right to cancel an order where, for example:
- A product is unavailable.
- There has been an obvious pricing or listing error.
- We are unable to fulfil the order.
- There is a suspected fraudulent transaction.
- A technical error has resulted in an incorrect order or price.
If we cancel an order after payment has been taken, you will receive a full refund of the amount paid for the cancelled order.
9. PRICES
All prices are displayed on our website in pounds sterling unless otherwise stated.
Prices may be changed at any time, but changes will not affect orders that we have already accepted.
Where applicable, delivery charges, taxes, customs duties or other charges will be identified during the checkout process or otherwise communicated to you.
10. PAYMENT
Payment must be made through the payment methods available through our Shopify checkout.
We do not consider an order confirmed until the payment process has been successfully completed.
11. DELIVERY
We will dispatch orders to the delivery address provided during checkout.
Delivery times are estimates unless a specific guaranteed delivery service has been agreed.
We are not responsible for delays caused by circumstances outside our reasonable control, including:
- Postal or courier delays.
- Customs processing.
- Severe weather.
- Strikes or industrial action.
- International shipping restrictions.
- Incorrect delivery information supplied by the customer.
For international orders, the customer is responsible for ensuring that the product can legally be imported into their country and for paying any applicable customs duties, import taxes or other charges imposed by the destination country.
12. INSPECTION ON DELIVERY
Please inspect your order as soon as reasonably possible after delivery.
If the parcel appears significantly damaged, please photograph the packaging before opening it where possible.
If parts are damaged or missing, contact us as soon as possible with:
- Your order number.
- Photographs of the packaging.
- Photographs of the affected parts.
- A description of the issue.
We will assess the issue and, where appropriate, provide replacement parts, a repair solution, refund or other appropriate remedy.
13. DAMAGED OR DEFECTIVE PRODUCTS
We take reasonable care when producing, inspecting and packaging our products.
If a product arrives damaged, defective or materially different from the product description, please contact us promptly.
Nothing in these Terms of Service affects your statutory rights under UK consumer law.
A component breaking solely because excessive force was applied during assembly, modification or preparation will not normally constitute a manufacturing defect.
14. CANCELLATION AND RETURNS
If you are a UK consumer purchasing online, you may have statutory cancellation rights under applicable consumer protection legislation.
For eligible online purchases, you generally have the right to cancel your order within 14 days of receiving the goods, followed by a further period to return the goods.
Returned products should be sent back in accordance with our returns instructions.
Products should be returned in an appropriate condition, subject to your legal right to inspect the goods as you would reasonably be able to do in a shop.
If a product has been assembled, cut, modified, sanded, glued, painted or otherwise altered beyond what is reasonably necessary to inspect the goods, your cancellation rights may be affected to the extent permitted by law.
This does not affect your statutory rights concerning faulty, defective or incorrectly supplied goods.
15. CUSTOM OR MADE-TO-ORDER PRODUCTS
Some products may be produced specifically following an individual customer's order.
Where a product is clearly identified as custom-made or personalised, statutory cancellation rights may differ where permitted by UK law.
This does not affect your rights if the product is faulty, defective or not as described.
16. ASSEMBLY AND MODIFICATION
Once a customer has modified a product, we cannot guarantee the structural integrity or performance of the modified parts.
This includes, but is not limited to:
- Cutting.
- Drilling.
- Sanding.
- Heating.
- Gluing.
- Pinning.
- Re-sculpting.
- Repositioning.
- Painting.
- Applying solvents or chemicals.
Customers are responsible for using suitable tools, adhesives, fillers, paints and other modelling materials.
Always follow the manufacturer's instructions and safety information for any modelling products used.
17. HEALTH AND SAFETY
Although our products are supplied as cured resin parts, preparation processes such as sanding, drilling or cutting can create dust or particles.
Customers should use appropriate personal protective equipment and work in a suitably ventilated area.
We strongly recommend:
- Using suitable respiratory protection when generating resin dust.
- Using suitable eye protection when cutting, drilling or sanding.
- Using dust extraction where practical.
- Washing hands after handling materials.
- Keeping work areas clean.
- Following the safety instructions supplied by manufacturers of adhesives, fillers, paints, primers and other chemicals.
Do not eat, drink or smoke while undertaking modelling work and do not use modelling materials in areas where food is prepared.
Customers are responsible for determining the appropriate safety precautions for their particular working environment.
18. CHILDREN
Our model kits are intended for adults and are not toys.
They contain small and potentially fragile components and may require the use of sharp tools, adhesives, fillers, paints and other modelling products.
Keep kits, components and modelling materials away from children unless being used under appropriate adult supervision.
19. INTELLECTUAL PROPERTY
All original product photographs, website content, branding, logos, descriptions, graphics and other material produced by Shadow Tier Figures remain the property of Shadow Tier Figures or their respective rights holders.
You may not reproduce, distribute, sell or commercially exploit our original content without prior written permission.
Where products are based on third-party intellectual property, any applicable rights remain with their respective owners.
20. LIMITATION OF LIABILITY
Nothing in these Terms limits or excludes liability where doing so would be unlawful.
Subject to that, Shadow Tier Figures will not be responsible for damage caused by:
- Incorrect assembly.
- Incorrect preparation.
- Incorrect use of tools.
- Excessive force applied to resin components.
- Inappropriate adhesives or chemicals.
- Modification of the product.
- Failure to follow safety instructions.
- Improper storage or handling.
- Normal wear, accidental damage or misuse.
Nothing in these Terms affects your statutory rights as a consumer.
21. EVENTS OUTSIDE OUR CONTROL
We will not be liable for failure or delay in performing our obligations where the failure or delay results from circumstances beyond our reasonable control.
This may include natural disasters, extreme weather, postal disruption, strikes, supply shortages, government restrictions, technical failures or other events that could not reasonably have been anticipated or prevented.
22. PRIVACY
We process customer information in accordance with our Privacy Policy.
Information provided during checkout may be used to process your order, arrange delivery, communicate with you regarding your purchase and fulfil our legal obligations.
23. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time.
The version applicable to your purchase will normally be the version displayed on our website at the time you place your order.
24. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer, nothing in these Terms removes or restricts any mandatory consumer rights that apply to you under the laws of the country in which you live.
